Welcome to the Inspirasien Platform!

Please read this Privacy Policy carefully before you start using Our Platform, because these rules apply to your use of Our Platform.

GENERAL

We believe that You should be able to make informed decisions about Your personal data.

We created this privacy policy (“Privacy Policy”) to inform and explain to you how we, PT Inspirasien Srikandi Indonesia and affiliates (“Inspirasien”, “We”, “us”, “Our”, or “Ours”) collect, use, process, disclose, and protect the Personal Data that You provide to Us through Inspirasien mobile application, website, and/or other platforms (collectively, the “Platform”), as requested or when using the Platform.

This Privacy Policy applies to all users, service provider partners (such as general practitioners, specialist doctors, psychologists, nurses, professional patient advocates, lay patient advocates or empowered patients) (“ Service Providers”), agents, vendors, suppliers, Our partners (such as pharmacies, labs, insurance partners and hospitals), and contractors (collectively “You” or “Your”), except as provided in a separate privacy policy. If You use the Platform on behalf of an individual other than You yourself, You represent that You are authorized by that individual to act on that individual's behalf and that individual acknowledges the practices and policies outlined in this Privacy Policy in accordance with the Laws and Regulations regarding Personal Data in force in the Republic of Indonesia.

This Privacy Policy is an integral part of Inspirasien Terms and Conditions of Use (“Terms of Use”). The use of the Platform and any features and/or services operated by Us (the “Services”) is a form of your agreement to the Terms of Use and this Privacy Policy. Therefore, You need to read this Privacy Policy carefully to ensure that You fully understand it before registering, accessing and/or using Our Platform and Services.
This Privacy Policy is provided to you in English and Indonesian language, both versions will be binding on you and us. In the event of any discrepancy between Indonesian and English language, Indonesian language version shall prevail.

  1. Preface

    Please note when You use the Platform, there may be various links to other platforms or websites belonging to third parties, including content thereof ("Third Party Platform"), which is provided for Your convenience. Inspirasien in this case is not responsible for the policies in managing Personal Data on the Third Party Platform. This Privacy Policy is only intended and applicable for the Services through the Platform. Inspirasien strongly recommends that You always carefully review and familiarize the policies of personal information management applicable on these Third Party Platform before providing Your personal information.

  2. Personal Data

    Personal data refers to all information, data and/or description in any form that can identify You, which from time to time You convey to us or that You include or convey in, on, and/or through the Platform regarding information related to You personally ("Personal Data"). Personal Data includes but not limited to Your full name, government-issued identification card number, address, date of birth, nationality, gender, mobile phone number (including but not limited to: IP address), location information, Your device data, IMEI number, name of the application attached to Your device), bank and credit card details, email address, Your picture, biometric data, marital status, personal health information, insurance information, financial information and other data classified as personal data.

    Please note that Personal Data does not include any personal information that is already available in the public domain.

  3. Accuracy of Personal Data
    1. We need Your Personal Data, one of which is to be able to process transactions within the Platform. Therefore, the Personal Data that You provide to Us must be as accurate as possible and not misleading. You must update and notify Us of any changes to Your Personal Data. You hereby indemnify Us from any demands, lawsuits, damages, and/or claims in connection with the failure of transaction processing and the use of Services on Our Platform caused by the inaccuracy of the Personal Data You provide to Us
    2. If You are under the minimum age requirement or are included in the category of children in accordance with the provisions of the applicable laws and regulations, or are not married or under guardianship, then You need the consent of Your parents, guardians or legal guardians to provide Personal Data to Us. If Your Personal Data is provided to Us, You hereby represent and warrant that Your parent, legal guardian or benefactor has consented to the processing of Your Personal Data and individually accepts and agrees to be bound by this Privacy Policy and is fully responsible for Your actions that are taken within Our Platform.
    3. In certain circumstances, You may provide Personal Data relating to other individuals (such as Your spouse and/or family members). In such circumstances, You represent and warrant that You have obtained such individual’s consent for, and hereby consent on behalf of such individual to, the collection, use, disclosure and processing of his/her Personal Data by Us.

  4. Personal Data Which We Collect

    Personal Data collected when You use the Platform, receive or provide the Services, includes:

    1. Personal Data collected from You as user to the Platform is, as follows:
      1. Personal Data submitted by You voluntarily and independently, including but not limited to Personal Data submitted when You:
        1. Create or update Inspirasien account, including but not limited to name, National Identity Number (NIK), date of birth, electronic mail address (e-mail), mobile phone number, address, photo, and/or other information;
        2. Upload Your personal data in connection with the provision of Services on the Platform, including but not limited to ID photo, gender, known health conditions, medications, allergies, vaccinations, medical history, health targets, health journal entries, prescriptions, reports, medical files, and/or other personal data, uploaded by You as a user from time to time on the Platform. This includes insurance information linked by You to Your account within Our Platform and information about family members, friends, beneficiaries, beneficial owners, attorneys, persons under the trust, trustees, guarantors, other insurance providers, and/or other individuals provided by You;
        3. Contact Inspirasien, including but not limited to through Our Platform’s help page or customer service for users;
        4. Submit any form, including, but not limited to, application forms or other forms relating to any of Our Services, whether online or by way of a physical form;
        5. Complete a survey sent by Inspirasien or on behalf of Inspirasien;
        6. Interact with Us, such as via letters, face-to-face meetings, social media platforms and emails;;
        7. Participate in contests or events organised by Us;
        8. Fill in payment data when You carry out payment activities through the Platform, including but not limited to credit card data (if applicable), and/or electronic wallet (e-wallet);
        9. Use features that require access to Your device; and/or
        10. Other data submitted through third party services in connection with the use of the Platform.
      2. Personal Data recorded when You use Platform, including but not limited to:
        1. Real or estimated location data, including but not limited to IP address, Wi-Fi location, geo-location, GPS coordinates, and other information provided by Your device. You may activate or deactivate location recognition service when You use Platform;
        2. Data in the form of Your activities, including but not limited to registration activities, logins, use of the Platform, payments (where Inspirasien can store details of the online payment methods You use on the Platform and transaction history), and others;
        3. Data related to teleconsultation services (which includes chat, video and audio call features, including microphone permissions), when You consult with the Service Providers including Professional Patient Advocates, Lay Patient Advocates or Empowered Patients via Our Platform. The teleconsultation feature within Our Platform allows You to upload and/or download pictures, have real-time audio and/or video calls over the Internet with the appointed Service Providers including Professional Patient Advocates, Lay Patient Advocates or Empowered Patients relating to Your medical conditions. Note: Audio and video permissions are only applicable when You are in a live teleconsultation chatroom and NOT when Our Platform is running in the background in Your device. By utilizing Our Platform, You are deemed to acknowledge and consent that any chat history services in text format may be collected, stored, utilized and/or disclosed by Us in accordance with this Privacy Policy. Meanwhile, all data related to video and audio call features will be utilized by Us only for the purpose of connecting You with the Service Providers including Professional Patient Advocates, Lay Patient Advocates or Empowered Patients for the purpose of providing Services to You. Service Providers including Professional Patient Advocates, Lay Patient Advocates or Empowered Patients within Our Platform for real-time teleconsultation session. WE DO NOT COLLECT, RECORD, USE OR STORE ANY AUDIO DATA WHEN YOU ARE NOT IN A LIVE TELECONSULTATION SESSION WITHIN OUR PLATFORM OR FOR LATER USE;
        4. Platform usage or configuration data, including Your interactions in using the Platform, saved options, and selected settings. The data is obtained using, including but not limited to cookies, pixel tags, and similar technologies that create and maintain unique identifiers;
        5. Device data, including the type of device used to access the Platform, including but not limited to hardware model, operating system and version, software, file name and version, language selection, unique device identifier, advertising identifier, serial number, device movement information, and/or cellular network information, as well as other additional data required by reference to a browser or application access request on Your device;
        6. Data records (logs), including records on servers that receive Personal Data such as device IP addresses, access dates and times, application features or pages viewed, application work processes and other system activities, browser type, and/or third party sites or services which You used before interacting with the Platform;
        7. Data obtained from camera access activities on Your device, provided that Your pre-approval has been obtained during the first time of using the Platform and that access is only for certain features or services on the Platform that must use the camera in order for using each Service to its full potential;
        8. Data You select from the contacts section of Your device for processing certain services within Our platform, for example: for sharing receiver’s contact details in medicine orders; and
        9. Platform will ask You for permission to use or access the camera, gallery, documents, network information, bluetooth, GPS location, microphone/audio, contact information, and/or internal/external storage of Your device when You upload and/or download documents in Our Platform in order to complete filling out health information or utilize Our Services (including downloading and uploading images, audio files, video files and documents selected by You to/from an internal/external storage on Your device or using any wireless devices). The Platform will not collect or use any other information, data or documents other than those selected by You.
    2. The Personal Data collected from You as a Service Provider including Professional Patient Advocates, Lay Patient Advocates or Empowered Patients in the Platform is as follows:
      1. Personal Data submitted by You voluntarily and independently or as requested by Inspirasien, including but not limited to Personal Data submitted when You create an account with Inspirasien, including but not limited to i) full name, ii) place and date of birth, iii ) electronic mail address (e-mail), iv) telephone number, v) address, vi) number and photo of Doctor's Registration Certificate (STR), Doctor's Practice License (SIP), vii) Tax Identification Number (NPWP), viii) details of bank account information and ix) profile photo of You as the Service Providers including Professional Patient Advocates, Lay Patient Advocates or Empowered Patients , for You to be able to use each Service on the Platform, such as teleconsultation facilities, especially for those of you who are general practitioners, specialists, midwives or psychologists;
      2. Personal Data provided by You when You enter into any agreement or provide other documentation or information in respect of Your interactions with Us, or when You use Our Services;
      3. Personal Data provided by You when You interact with Us, such as via telephone calls (which may be recorded), letters, face-to-face meetings, social media platforms and emails; and
      4. Personal Data recorded when You use Our Platform, as elaborated above. Note: By using the Platform, You as Service Provider including Professional Patient Advocates, Lay Patient Advocates or Empowered Patients guarantees that the information You provide is accurate and correct. You acknowledge and agree that We have the right to verify directly with You the information regarding personal data that has been submitted by You through the Platform. If the information You provide turns out to be incorrect, We will not be responsible for any consequences that may occur in connection with the provision and use of such incorrect information.
    3. Operational data: To improve the experience of using the Platform, Inspirasien may use cookies, server logs and other similar mechanisms to enable certain functions, improve the Services, monitor the use of the Services, and for marketing purposes within and outside the Platform. This mechanism is used to store user preferences, maintain session settings, assist with automatic authentication for frequently used Services if required by your setup, and enable other similar functional requirements. You can use Your browser settings to disable cookies while using the Platform. However, this may result in You being unable to access all or part of the Platform, or to use all or part of the functionality within the Platform. Our third party partners may also automatically receive and store non-personal information or anonymous data about Your online activities over time.
    4. Personal Data collected from other sources, including but not limited to:
      1. Partners assisting Inspirasien in the development and provision of Services on the Platform to You, including but not limited to Service Providers including Professional Patient Advocates, Lay Patient Advocates or Empowered Patients, payment service provider partners, delivery service provider partners, telecommunication company partners and/or other partners;
      2. Third parties used by You as user to create or access a Inspirasien account, including but not limited to social media services, or sites or applications that use the Inspirasien API or that Inspirasien uses;
      3. Marketing service providers; and/or
      4. Generally available sources. Inspirasien may combine and/or process Personal Data obtained from these sources with other Personal Data belonging to Us.

      In the event that there is additional Personal Data that Inspirasien collects from You, Inspirasien will ask for additional consent from You while taking into account the protection of Your personal data.

  5. The Use of Personal Data Which We Collect
    1. We may use Personal Data collected for the following purposes or for other purposes permitted by applicable laws and regulations:
      1. If You are a user, We may use Your Personal Data:
        1. to identify and register You as a user and to administer, verify, deactivate or manage Your account on the Platform. For example, the information that You provide in the process of purchasing laboratory tests through the Platform will be used by Us for the registration process and ordering tests at the relevant laboratory;
        2. to facilitate or enable any verification that, in Our consideration, is necessary before Service provider provides the Services to you or before We register You as a user, including implementing the Know Your Customer (KYC) process;
        3. to enable Service provider in providing Service that You request;
        4. to process and facilitate Your payment;
        5. to inform You for any transaction or activities occurring within the Platform or other system connected to Our Platform;
        6. to provide the creation of prescriptions and/or medicines according to Your request in connection with Our services within the Platform;
        7. to communicate with You and send You information related with the use of Platform;
        8. to diagnose and solve problems related to difficulties in accessing the Service (troubleshoot);
        9. to notify you of updates to the Platform or changes to the Services provided;
        10. to maintain, develop, test, improve and personalize the products and services on the Platform to meet Your needs and preferences as a user;
        11. to monitor and analyze Your activity, behavior and demographic data as a user including Your habits and use of various Services available on the Platform;
        12. to process and respond to questions, comments and feedback received from You;
        13. to offer or provide services from Our affiliates or partners;
        14. to send you direct, targeted or personalized marketing communications, advertisement, vouchers, surveys, and information on special offers or promotions;
        15. to provide information/send e-mails and/or SMS containing promotions periodically to You when there is an offer and/or promotion of new products, special offers, or other information that We deem is required by You; and/or
        16. for any other purposes that We notify You of when We collect Personal Data.
      2. If You are service provider (including Service Providers such as Professional Patient Advocates, Lay Patient Advocates or Empowered Patients), We may use Your Personal Data:
        1. to identify You and register You as a service provider and to administer, manage or verify Your account on the Platform;
        2. to facilitate or enable any verification that, in Our full discretion, is necessary before We can register You as a service provider within Our Platform, including for KYC (Know Your Customer) purposes;
        3. to enable You to provide the Services to users;
        4. to process, facilitate, and settle payments due to You in relation to the Services You have provided;
        5. to communicate with You and send You information related to the provision of Your Services;
        6. to provide You with notification and updates on the Platform or changes to the way the Services is provided;
        7. to provide You with reports relating to the Services You have provided;
        8. to process and respond to suggestions from users on the Services You have provided;
        9. to maintain, develop, test, improve and personalize the Platform to meet Your needs and preferences as a service provider;
        10. to monitor and analyze user activity, behavior, and demographic data including the habits and responsiveness of Service providers for various services available on the Platform;
        11. to offer or provide Services from our affiliates or partners; and/or
        12. to send you direct or targeted marketing communications, advertisements, promotions, surveys and special offers or promotions.
      3. Whether You are a user or service provider or any party providing Personal Data to Us, We can also use Your personal data more generally for the following purposes (although in certain cases We will act fairly and not use Your Personal Data more than what is needed for the purpose):
        1. to perform related business processes and functions;
        2. to monitor the use of the Platform and manage, support and improve the efficiency of the performance, development, user experience and functions of the Platform;
        3. to provide assistance in connection with and to resolve technical difficulties or operational problems with the Platform or Services;
        4. to produce statistical information and analytical data for the purposes of testing, research, analysis, product development, commercial partnerships and collaborations;
        5. to prevent, detect and investigate any prohibited, illegal, unauthorized or fraudulent activities;
        6. to facilitate business asset transactions (which can be in the form of mergers, acquisitions, or asset sales) involving Us and/or Our affiliates; and/or
        7. to enable Us to comply with all obligations under applicable laws and regulations, including but not limited to responding to requests, investigations, or regulatory directives, complying with filing, reporting, and licensing requirements required by applicable regulations) and conducting audit checks, due diligence and investigation.
    2. Your Personal Data provided through the Platform and/or through the use of the Services, which You do not make publicly accessible, will not be shared, disclosed, or displayed to any party, unless You and the relevant Service Providers including Professional Patient Advocates, Lay Patient Advocates or Empowered Patients, You choose to consult through Our Platform. Personal Data will be used by Service Providers including Professional Patient Advocates, Lay Patient Advocates or Empowered Patients for the purpose of providing Services to You. Service Providers including Professional Patient Advocates, Lay Patient Advocates or Empowered Patients will be provided with access to Your Personal Data and they will be allowed to update the information by adding review notes, health targets, monitoring relevant feedback, or comments as part of the Services You request.. Service Providers including Professional Patient Advocates, Lay Patient Advocates or Empowered Patients may terminate any Services provided to any customer, at any time, at their sole discretion, and in this case, the Service Provider including Professional Patient Advocates, Lay Patient Advocates or Empowered Patients for the purpose of providing Services to You. Service Providers including Professional Patient Advocates, Lay Patient Advocates or Empowered Patients will no longer have access to Your Personal Data as the relevant customer upon termination.
    3. You are allowed to share Your Personal Data with other parties at Your own risk. Inspirasien is not responsible for the compliance of other parties, who will see and use any information disclosed by You, to the Privacy Policy.
    4. We may also use Personal Data without consent, relying on legitimate interests or other exceptions provided by applicable data privacy laws, for purposes such as i) complying with applicable laws and regulations; ii) investigate potential fraud or illegal acts; or iii) protect Our brand, Our reputation or Our ownerships. We may also use Your Personal Data when We are required, advised, recommended, expected or asked to do so by Our legal counsel or local or foreign legal counsel, regulatory, governmental or other authorities.
    5. We may use Your Personal Data to send You (including but not limited to via email and/or Short Message Service (SMS) to Your telephone number): (i) important messages regarding the Services, as well as (ii) marketing and non-marketing materials related to with certain services or products that We think are of interest to You. By using the Platform, You are deemed to give your consent to receive these messages and marketing or non-marketing materials that We send either via email, SMS or other means of communication. If at any time You decide You no longer wish to receive marketing communications from Us, please follow the unsubscribe instructions provided in the communication, or You can reach out to Us through the communication channels set out in the "Contact Us" section of this Privacy Policy.
  6. Sharing of Personal Data Which We Collect
    1. We may disclose, provide access to or share Your Personal Data with affiliates and/or other parties for the following purposes and for other purposes insofar as permitted by applicable laws and regulations:
      1. if you are a user, to enable a Service provider, to perform or provide the Services;
      2. if you are a Service provider, to enable users to request or receive Services from You;
      3. if required or authorized by applicable laws and regulations (including but not limited to responding to inquiries regarding regulations, investigations or guidelines, or complying with statutory filing and reporting requirements or conditions), for the purposes specified in applicable laws and regulations;
      4. if instructed, requested, required or permitted by the competent government, for the purposes as stated in the applicable government policy, regulation or legislation, including but not limited to where disclosure is required for medical review;
      5. for the purposes of internal investigations of criminal acts or violations of regulations or policies within Inspirasien and its affiliated companies;
      6. if there is a legal process of any kind between You and Us, or between You and other party, in connection with, or related to the Services on the Platform, for the purposes of the legal process;
      7. in connection with all verification processes that We and/or third parties require before the Service provider provides Services to You or We register You as a user, including but not limited to the KYC (Know Your Customer) process;
      8. in an emergency regarding Your safety (whether You are a user or Service provider) for the purposes of dealing with such an emergency. This includes protecting the safety of Inspirasien and its affiliated companies, Your safety or the safety of others or for the legitimate interests of any party in the context of national security, law enforcement, litigation, criminal investigations or to prevent outbreaks, and/or state of emergencies as determined by the Government;
      9. in situations related to Your health or public interest (whether You are a user or Service provider), We may share Your Personal Data with the competent government and/or other institutions that may be appointed by the competent government or have cooperation with Us, for contact tracking purposes, support initiatives, policies or programs of government, public health and other purposes as reasonably necessary;
      10. in connection with, merger, sale of company assets, consolidation or restructuring, financing or acquisition of all or part of Our business by or to another company, for the purposes of such transaction (even if the transaction is discontinued);
      11. in connection with the insurance claim process, We will share Your Personal Data for the purpose of processing insurance claims with insurance companies that cooperate or collaborate with Us;
      12. to third parties (including agents, vendors, suppliers, contractors, partners, and other parties who provide services to Us or You, perform tasks on Our behalf, or parties with whom We enter into commercial cooperation with), for or in connection with the purposes for which the third party is involved, to carry out disclosures to the relevant third party that are technically necessary to process Your transaction related to any Services or the purpose of Our cooperation with the third party (depending on the circumstances), which may include allowing the third party to introduce or offer products or services to You, authenticate You or connect You with the Platform and/or perform other activities including selling, marketing, research, analysis and product development. In connection with this disclosure, We will make best efforts to protect Your Personal Data, such as but not limited to being performed anonymously (by eliminating your personal identification) and carried out after signing a confidentiality agreement;
      13. in the event that We share Personal Data with affiliates, members of our business group, which includes branches and subsidiaries, as well as the main parent company and its subsidiaries, We will do so with the intention that they assist Us in providing Services within the Platform, for the implementation of support for the provision of the Platform by them, to operate / implement Our business activities and/or for the purpose of processing Personal Data on Our behalf. For example, an Inspirasien affiliate in another country may process and/or store Your Personal Data on behalf of a Inspirasien group company in Your country. All of Our affiliates are committed to processing Personal Data they receive from Us in accordance with this Privacy Policy and applicable laws and regulations;
      14. We may share your Personal Data with advertisers and advertising networks who need Your Personal Data to select and offer relevant advertisements to You and/or other users. We may use the Personal Data We collect to fulfill advertisers' requests by showing their ads to that target audience; and/or
      15. to carry out the activities as described in section E (Use of Personal Data).
    2. Especially for You as a Service provider on the Platform, including general practitioners, specialists, psychologists and midwives, by using the Platform, You are deemed to have agreed to allow certain third parties to use Your Personal Data to provide You with information about the goods and services You need. Such third parties include but are not limited to:
      1. Insurance that will require proof of Services You have provided and/or a medical report You have made or if they require for authorization of Services or referrals;
      2. Service providers by third parties (including but not limited to: x-ray services or laboratory testing services) upon Your referral;
      3. Our business partners, such as pharmacy partners, billing services, or those who provide administrative services for Us. We have underlying agreements with each of Our business partners and service providers are required to protect the confidentiality and security of the information passed on to them.
      4. Research and marketing companies related to promotions performed by Us.
      5. Service providers related to information technology (IT) such as infrastructure services, cloud computing, software, analysis development "Big Data" and "Machine Learning", including services to perform "Cleansing Data", "Data Insight", "Credit Scoring" and others.
      6. Payment transaction processing service provider companies which include payment gateway providers, fund transfers, electronic wallets, and other payment system service providers related to transactions made in the Platform.
    3. Where Personal Data does not need to be associated with You, We will make reasonable efforts to remove the Personal Data from being associated with You as an individual prior to disclosing or sharing such information.
    4. We will not sell or lease Your Personal Data.
    5. In addition to as set out in this Privacy Policy, We may disclose and share Your Personal Data if We notify You and We have obtained Your consent for such disclosure or sharing.
  7. Cookies
    1. Cookies mean small files that will automatically take place on Your device which performs the function of storing Your preferences and configurations while visiting a site. Cookies are not intended to be used when accessing other data that You have on Your computer device, other than what You have agreed to submit.
    2. Although Your computer device will automatically accept cookies, You may choose to make modifications through Your browser setting, namely by choosing to reject cookies (this option may hinder the optimal availability of Our Services when You access the Platform).
    3. We are using Google Analytics. Data obtained by Us from such features, such as age, gender, Your interest and other identifiable information of You, will be used by Us for the development of features, facilities and/or contents available on the Platform. If You do not wish for Google Analytics to track Your Personal Data, You may use Add-On Google Analytics Opt-Out within Your browser.
    4. Inspirasien may use features provided by third parties for the purpose of improving Inspirasien’s services and contents, including the assessment, adjustment and serving of advertisements to You based on Your interest or visit history of the Platform. If You do not wish for any advertisement to be displayed based on such adjustment, You may set it via browser.
  8. Storage of Personal Data
    1. To the extent permitted by the relevant laws and regulations, all Personal Data that You provide will be stored by Us: (i) as long as You are a user of Our Platform and (ii) when the retention period begins from the date on which You stop using Our Platform and/or since the request for deletion of Your account and Personal Data; or (iii) in accordance with the original purpose for which the Personal Data was collected.
    2. Your Personal Data that We collect may be stored, transferred or processed outside of Indonesia by parties working for Inspirasien in other countries, or by third party service providers, vendors, suppliers, partners, contractors or Inspirasien affiliates for one or more of the following purposes as mentioned in this Privacy Policy. Inspirasien will always make reasonable endeavors to ensure that these parties provide an equivalent level of protection with Inspirasien's commitments under this Privacy Policy. You understand and give Your consent to the transfer of Your Personal Data outside Indonesia.
    3. Inspirasien will delete and/or anonymize Your Personal Data which is under Inspirasien's control if (i) Your Personal Data is no longer necessary to fulfill the purpose for which it was collected; and (ii) the retention is no longer required for the purpose of compliance with applicable laws and regulations.

Service Providers including Professional Patient Advocates, Lay Patient Advocates or Empowered Patients, pharmacy, lab, insurance and/or hospital partners and/or driver partner in delivering medicines), made other than through the use of the Platform (such as by telephone calls, SMS, mobile messaging or other method of communication and collection of Your Personal Data by Our partner) may also be retained by some means. We do not encourage the retention of Personal Data by such means and We have no responsibility to You for the same. We shall not be liable for any such retention of your Personal Data. You agree to indemnify, defend and release Us, Our officers, directors, employees, agents, partners, suppliers, contractors and affiliates from and against any and all claims, losses, liabilities, expenses, damages and costs (including but not limited to legal costs and expenses on a full indemnity basis) resulting directly or indirectly from any unauthorized retention of Your Personal Data.
  9. Erasure and Delisting of Personal Data
    1. We generally retain Your Personal Data for as long as necessary for the implementation of the agreement between You and Us and/or to comply with Our legal obligations. If You no longer want Us to use Your Personal Data to provide the Platform to You, You can ask us to delete Your personal data and close Your account.
    2. Please note that if You request deletion of Your Personal Data: We may retain some of Your Personal Data as necessary for Our legitimate business interests, such as detecting and preventing fraud and enhancing security. For example, if We suspend an account due to fraud or security reasons, We may retain certain information from that account to prevent that member from opening a new account on the Platform in the future. We may retain and use Your Personal Data to the extent necessary to comply with Our legal obligations. For example, We may retain some of your information for tax, legal reporting, and auditing obligations. As We maintain the Platform to protect against accidental or malicious loss and damage, residual copies of Your Personal Data cannot be deleted from Our backup system for a limited period of time.
    3. In accordance with the applicable laws and regulations, upon Your written request, Inspirasien may delete (right to erasure) and/or destroy Your Personal Data from the system (right to delisting) so that the data no longer identifies You, except in the case of:
      1. If We need to store Personal Data to fulfill legal, tax, audit, and/or accounting obligations, We will store the necessary Personal Data as long as you are still using the Platform or according to the period required by applicable laws;
      2. Your Personal Data is still within the retention period pursuant to the applicable laws and regulations; and/or
      3. For the purpose of destroying Your Personal Data from the system (right to delisting), a court order is required which is submitted by You so that We can destroy Your irrelevant Personal Data from the list of search engines under the management of Inspirasien.
  10. Your Rights over Personal Data
    1. You may access and modify Your Personal Data including email address, phone number, and date of birth directly within the Platform.
    2. Insofar as it does not run in conflict with the provisions of the applicable laws and regulations, You may contact Inspirasien to withdraw Your consent to the utilization of Your Personal Data in accordance with this Privacy Policy. In such circumstances, You understand the consequences that You may not use the Services on the Platform or other Inspirasien services.
    3. ou have the right to access, correct or obtain a copy of Your Personal Data which is under Inspirasien's control by contacting Us via the chat feature with Our customer service team within the Inspirasien app. The application will only be processed by Inspirasien if You have submitted sufficient proof of identity to access, correct or request the copy of the data. Inspirasien reserves the right to refuse requests to access, or to correct, some or all of Your Personal Data that Inspirasien owns or controls if permitted or required under applicable laws. This includes circumstances where the Personal Data may contain references to others or where a request for access or a request for correction is for reasons that Inspirasien deems irrelevant, not serious or renders difficult.
      To the extent permitted by the prevailing laws and regulations, Inspirasien reserves the right to charge you a reasonable administrative fee for handling your request to access, correct or obtain a copy of Your Personal Data. If so, We will notify You of the fee before processing Your request. Inspirasien will respond to your request regarding access, correction or request for a copy of Personal Data in accordance with the time provisions determined by the applicable laws and regulations in Indonesia.
    4. If You wish to exercise Your other rights as a data subject pursuant to the applicable laws and regulations in Indonesia, You can contact Us via the chat feature with our customer service team within the Inspirasien app.
  11. Security of Your Personal Data
    1. The confidentiality of Your Personal Data is of utmost importance to Inspirasien. We guarantee that the data and information provided by You is confidential and will not be shared, except for the matters that have been stated and agreed by You in this Privacy Policy. We apply Our best efforts to protect and secure Your Personal Data from access to collection, processing, analysis, storage, disclosure, amendment and deletion by unauthorized parties in the form of physical, electronic, and managerial security measures. For the security of Your data, We strongly recommend that You always update Our platform from time to time.
    2. Although We use Our best efforts to secure and protect Your Personal Data, please note that data transmission over the Internet is never completely secure. Thus, Inspirasien cannot guarantee 100% security of the data provided or sent to Inspirasien by You and the provision of information by You is at Your own risk. If We experience a data breach related to Your Personal Data, to the extent required by applicable laws and regulations, We will notify You through Our official channel, either directly or indirectly, to provide You with sufficient information regarding the data breach and will work to safeguard against misuse of Your Personal Data.

You are responsible for maintaining the confidentiality of Your account details, including telephone number, email, password (as applicable), and one-time password (OTP) with anyone and must always maintain and be responsible for the security of the devices You use. You will indemnify Inspirasien from any loss or claims in the event that You are negligent in maintaining the confidentiality of Your Inspirasien account details, including Your password, email or one-time password (OTP), as well as in the event that You are negligent in maintaining the security of the device You are using.
    4. The obligation to keep the Personal Data confidential shall not or no longer apply to Personal Data which:
      1. is publicly known at the time of disclosure, or which becomes publicly known thereafter in ways other than by Our acts or omissions;
      2. We properly obtained from a third party without any accompanying obligation to keep it confidential;
      3. its disclosure has been authorized by You; and
      4. is required by laws and regulations to be disclosed or to the extent required to be disclosed by, an order of a court, or of any other competent government authorities, in any country with jurisdiction.

    This Privacy Policy is governed by the laws of the Republic of Indonesia and You are required to comply with all applicable regulations in the Republic of Indonesia.
